Terms of Service
By accessing or using HMRClever, you agree to be bound by these Terms of Service. Please read them carefully before using the platform.
1. Acceptance of Terms
By creating an account, accessing, or using HMRClever (the "Service"), you agree to comply with and be legally bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws and regulations. If you do not agree to these Terms, you must not use the Service.
These Terms constitute a legally binding agreement between you ("User", "you", or "your") and HMRClever ("we", "us", or "our").
2. Description of Service
HMRClever is a Software-as-a-Service (SaaS) platform designed to help UK individuals:
- Track personal and household finances
- Record income from multiple sources (employment, self-employment, dividends, property, pensions)
- Log expenses and deductions
- Estimate their UK tax liability for the current tax year
- Monitor account balances and net worth
- Generate financial reports and insights
IMPORTANT: HMRClever provides tax estimates based on the data you input and our understanding of UK tax rules. These estimates are for informational purposes only and do NOT constitute professional tax advice, financial advice, or accounting services.
- Tax calculations are estimates and may not reflect your actual tax liability
- We cannot guarantee the accuracy or completeness of tax estimates
- Tax rules are complex and subject to change; our calculations may not cover all scenarios or reliefs applicable to your situation
- You remain solely responsible for filing accurate tax returns with HMRC
- You should consult a qualified accountant or tax advisor before making financial decisions or submitting tax returns
By using the Service, you acknowledge that HMRClever is a tool to help you estimate and track your tax position, not a replacement for professional advice.
3. Account Registration and Responsibilities
3.1 Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts to use the Service. The Service is intended for UK residents or individuals with UK tax obligations.
3.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account password
- All activities that occur under your account
- Notifying us immediately if you suspect unauthorised access
We are not liable for any loss or damage arising from your failure to protect your account credentials.
3.3 Accurate Information
You agree to provide accurate, current, and complete information when using the Service. The accuracy of tax estimates depends on the data you input. Inaccurate or incomplete data will result in unreliable estimates.
4. Subscription Terms
4.1 Free Trial
New users receive a 1-month free trial of the Service. During the trial period, you have full access to all features. No payment is required during the trial.
4.2 Paid Subscription
After the free trial ends, continued access to the Service requires a paid subscription at £4.99 per month (GBP).
- Subscriptions automatically renew each month unless cancelled
- Payments are processed via Stripe, our third-party payment processor
- All fees are non-refundable except as required by law
- Prices are subject to change with at least 30 days' notice
4.3 Billing
By subscribing, you authorise us to charge your payment method on a recurring monthly basis. If a payment fails:
- We will attempt to notify you via email
- Your access to the Service may be suspended until payment is received
- If payment is not resolved within a reasonable period, your account may be downgraded or deleted
4.4 Cancellation
You may cancel your subscription at any time from your account settings. Upon cancellation:
- You will continue to have access until the end of your current billing period
- No further charges will be made
- No refunds will be issued for partial months
- Your data will be retained for 30 days in case you wish to reactivate; after that, it will be deleted in accordance with our Privacy Policy
5. Acceptable Use
You agree NOT to:
- Use the Service for any illegal or unauthorised purpose
- Violate any laws in your jurisdiction (including but not limited to tax fraud or money laundering)
- Attempt to gain unauthorised access to our systems or other users' accounts
- Interfere with or disrupt the Service or servers
- Use automated scripts, bots, or scrapers to access the Service
- Reverse engineer, decompile, or disassemble any part of the Service
- Upload malicious code, viruses, or harmful content
- Impersonate any person or entity
- Share your account credentials with others
Violation of these terms may result in immediate termination of your account without refund.
6. Intellectual Property
All content, features, functionality, code, design, and trademarks of HMRClever are owned by us or our licensors and are protected by UK and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for your personal financial management only. This licence does not include any rights to:
- Resell or commercialise the Service
- Copy, modify, or create derivative works
- Extract or reuse any data, algorithms, or calculations for commercial purposes
7. User Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.
You retain ownership of any data you input into the Service. By using the Service, you grant us a licence to use, store, and process your data solely for the purpose of providing and improving the Service.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY UK LAW:
- The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied
- We do not warrant that the Service will be uninterrupted, error-free, secure, or free of bugs
- We are not liable for any tax penalties, fines, or interest charges resulting from inaccurate tax estimates or late filings
- We are not liable for any financial losses resulting from your reliance on tax calculations or financial reports generated by the Service
- We are not responsible for third-party service outages (e.g., Supabase, Stripe) that may affect the Service
In no event shall HMRClever be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.
Our total liability to you for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless HMRClever, its officers, employees, and service providers from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any inaccurate or misleading information you provide
10. Termination
10.1 Termination by You
You may terminate your account at any time by cancelling your subscription and requesting account deletion via support@hmrclever.com.
10.2 Termination by Us
We reserve the right to suspend or terminate your account immediately, without notice, if:
- You violate these Terms
- You engage in fraudulent or illegal activity
- Your payment method fails and remains unresolved
- We cease providing the Service
Upon termination, your right to access the Service ceases immediately. We may delete your data in accordance with our Privacy Policy.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Before initiating legal proceedings, you agree to attempt to resolve disputes informally by contacting us at support@hmrclever.com.
12. Changes to These Terms
We may modify these Terms from time to time. If we make material changes, we will notify you via email or a prominent notice on the Service at least 30 days before the changes take effect.
Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you must cancel your subscription and stop using the Service.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court, the remaining provisions shall remain in full force and effect.
14. Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and HMRClever regarding the Service and supersede any prior agreements.
